Georgia Leads with New ADR Rules

While some of Georgia’s Probate Courts have regularly referred cases to mediation, the use of mediation in probate matters remains relatively low compared to its use in other courts. On May 3, 2023, with support of the Probate Judges’ Council, the Supreme Court of Georgia Commission on Dispute Resolution (GCDR) approved a new neutral registration category for Probate Mediation to encourage the use of mediation. Now that registration has been approved and the Supreme Court ADR Rules modified, the GCDR is in the process of executing its implementation plan to educate and train stakeholders. In this session, attendees will learn more about what this means for judges and court staff, attorneys, registered neutrals, and the public.

Moderator

Tracy B. Johnson

Tracy B. Johnson is the Executive Director for the Georgia Office of Dispute Resolution (GODR). Tracy has been a registered mediator since 1996 in the categories of General Civil, Domestic Relations, and Specialized Domestic Violence. Tracy previously served for 17 years as the Director for the 6th District ADR Program. From December 2013 until June 2016, Tracy led the Superior Court of Fulton County Family Division which also included the Family Law Information Center, Alternative Dispute Resolution Office, and One Stop Office for Temporary Protective Orders.

Hon. Carrie B. Markham

Judge Markham, a native of Newnan, Georgia, practiced law for 15 years before taking office as Probate Court Judge in January of 2020.  She was named the 2023 Outstanding Probate Judge of the Year by the Council of Probate Court Judges of Georgia. She currently serves as the chair of the council’s Forms and Rules Committee and is a member of the Supreme Court of Georgia Commission on Dispute Resolution (GCDR).

Eleanor Crosby Lanier, Esq.

Eleanor Crosby Lanier retired from the University of Georgia School ofLaw on July 1, 2020, where she served as associate dean for clinical programs and experiential learning and was a clinical professor teaching General Civil Mediation and Elder Law. She has been a pioneer in promoting the use of mediation in elder care disputes, providing training for mediators in several states and working with the Association for Conflict Resolution to develop training objectives for mediators in elder care, long-term care and adult guardianship cases.

Barbara Koll, Esq.

Barbara J. Koll worked for the Fulton CountyProbate Court for over 37 years serving in various capacities including SeniorStaff Attorney, Judicial Hearing Officer and Chief Clerk/Court Administrator.Ms. Koll retired from the Court in February 2023. She is a Registered Neutral with GCDR.

Those attending the conference in person will have a choice between two breakout sessions, held at 10:00 AM and 2:15 PM. Continuing Education Information

Probate Preeminence is approved for 1 hour of CE for registered neutrals (GA) & 1 hour of CLE for Georgia attorneys (pending).

The total conference is approved for 6 hours of CE for registered neutrals and is approved by the State Bar of Georgia for 6 CLE hours, including ethics, trial, and professionalism credit.

Georgia Attorneys who purchase the appropriate ticket option will have CLE hours automatically reported to the State Bar of Georgia. The fee for CLE hours is included in the ticket price.
